LEARN THE LEGAL LIMITS

The sale of a house to foreigners is not subject to the same procedures as the sale of a house to any citizen in the country. First of all, it should be known that a foreigner who will buy a house in any province of Turkey does not need a residence permit. However, this situation should not be perceived as there is no legal regulation during the sale of houses to foreigners. In Article 35 of the Land Registry Law numbered 2644, the restrictions and rights that foreigners encounter during their home buying process are as follows: They can also acquire real estate and limited real rights.

The total area of ​​immovables acquired by real persons of foreign nationality and limited real rights of an independent and permanent nature cannot exceed ten percent of the area of ​​the district subject to private ownership and thirty hectares per person throughout the country. "The amount of independent and permanent limited real rights and immovables acquired by me within the borders of the Republic of Turkey, including this immovable property, does not exceed thirty hectares. If the opposite is determined, I unconditionally accept and undertake that the excess amount will be liquidated and converted into value."

DON'T FORGET TO MAKE AN APPOINTMENT

Housing owners who want to sell houses to foreigners must first make an appointment with the e-government system or the General Directorate of Land Registry and Cadastre. Appointments to be made online can also be made online through the Land Registry Appointment System of the Directorate of Land Registry and Cadastre. PREPARE YOUR DOCUMENTS COMPLETELY

• Deed document of the house

• Identity document and passport (translation of the passport by a sworn translator can be requested)

• 1 photo of the seller and 2 photos of the foreign buyer (The photo should reflect the current state of the people, be taken in the last 6 months, and be 6 x 4 cm in size)

• Real estate fair value certificate (This document is obtained from the relevant municipality)

• Compulsory earthquake insurance policy

• Sworn translator if one of the parties does not speak Turkish

• If there is a proxy, a power of attorney (if the power of attorney is issued by the authorities of foreign countries, a notarized translation and an apostille annotation are required) In addition, an appraisal report showing the value of the house to be sold must also be present.
